Terms of Service

Effective July 5, 2026

These Terms of Service ("Terms") govern your use of LexiTar, a free public health literacy utility operated by the Tiny Tars Foundation, a registered 501(c)(3) tax-exempt charitable organization (EIN: 39-2278196) ("we," "us," or "the Foundation"). By accessing or using LexiTar or this website, you agree to these Terms. If you do not agree, please do not use the service.

Who may use LexiTar

LexiTar is intended for adults who are at least 16 years old and who use it to manage their own health information. By using it, you confirm that you meet this requirement and that any information you enter is your own or that you are authorized to enter it.

What LexiTar is — and is not

Educational purpose only. LexiTar is an educational health literacy resource intended solely to support patient self-advocacy and to improve communication between you and your healthcare providers. It helps you translate terminology, organize your records, view general reference ranges, and prepare questions and summaries for your own physician.

Not medical advice. LexiTar does not provide medical advice, professional diagnosis, symptom triage, or treatment recommendations, and it is not a medical device. The information, biomarker reference translations, and physician-preparation materials it generates are for educational purposes only. They may be incomplete or may not apply to your specific circumstances. Always consult a qualified, licensed physician or other healthcare professional about any medical condition, laboratory result, or change to your health regimen. Never disregard professional medical advice, or delay seeking it, because of something you read or generate on this platform. In an emergency, call your local emergency number.

No provider relationship. Using LexiTar does not create a physician–patient or other professional relationship between you and the Foundation, and the Foundation is not a HIPAA covered entity.

Accounts and the waitlist

Access to the dashboard is invitation-based while the service is in early release. If you join the waitlist, you agree to provide accurate contact details. You are responsible for keeping your account credentials and personal encryption key confidential and for all activity under your account. Because your data is encrypted with a key you control, we cannot recover your content if you lose that key.

Acceptable use

You agree to use LexiTar only for your own personal, non-commercial health literacy and advocacy. You will not: use it to provide medical services to others; attempt to identify, contact, or de-anonymize other users; upload unlawful content or data you have no right to use; interfere with, overload, probe, or attempt to circumvent the security of the service; or use automated means to scrape or misuse it. We may suspend or end access that violates these Terms or that risks harm to others or to the service.

Intellectual property

LexiTar is a donor-supported public benefit utility provided by the Tiny Tars Foundation. The Foundation's name, logos, software, and brand — including "Tiny Tars Foundation" and "LexiTar" — remain the property of the Foundation and may not be used in a way that suggests endorsement without our permission. You retain all rights to the health information you enter; we claim no ownership of your data.

Privacy

Your use of LexiTar is also governed by our Privacy & Data Security policy, which explains how we protect your information and our commitment never to sell it or use it for advertising.

Disclaimer of warranties

LexiTar is provided free of charge, "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any translation, reference range, or summary it produces is accurate, complete, or suitable for your situation.

Limitation of liability

To the fullest extent permitted by law, the Tiny Tars Foundation and its trustees, staff, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on information generated by LexiTar or from any decision made or delayed based on it. Nothing in these Terms limits liability that cannot be limited under applicable law. Because LexiTar is offered without charge as a charitable service, our aggregate liability to you is limited to the greatest extent the law allows.

Indemnification

You agree to indemnify and hold harmless the Foundation from claims arising out of your misuse of LexiTar or your violation of these Terms or of any law or the rights of another.

Changes and termination

We may update, suspend, or discontinue LexiTar, or update these Terms, at any time. If we materially change these Terms, we will revise the effective date above. Your continued use after a change means you accept the updated Terms. You may stop using the service at any time.

Governing law

These Terms are governed by the laws of the United States and of the state in which the Tiny Tars Foundation maintains its principal place of business, without regard to conflict-of-laws principles.
